Terms of Service
Last updated: 26 October 2026
Who we are: Vocalis Desk is a sole-trader business based in Perth, Western Australia. Contact: support@vocalisdesk.com.
These terms are an agreement between Vocalis Desk ("we", "us") and the business that signs up ("you"). By starting a trial or using Vocalis Desk, you agree to them. You must be 18 or over and authorised to act for the business you sign up. Please also read our Privacy Policy.
1. The service
Vocalis Desk provides an AI phone receptionist that answers calls forwarded from your phone number, answers questions using the information you give us, makes bookings, takes messages and can transfer urgent calls. It includes a dashboard with your calls, recordings, transcripts, bookings and reports, plus any other services in the plan you choose.
2. Free trial
New plans start with a free trial (currently 7 days). A card is required. Unless you cancel before the trial ends, your plan starts automatically and we charge your one-off setup fee plus your first month's fee, both shown at signup (for example $999 + $699 = $1,698 for the Voice Agent plan). Cancel during the trial and you pay nothing.
3. Prices and billing
- Setup fee: a one-off fee, charged with your first bill after the trial (or at signup, if shown).
- Monthly fee: charged in advance each billing period.
- Call minutes: each plan includes a number of call minutes per billing period, shown at signup and on our website. Extra minutes are charged at the rate shown for your plan ($0.39 a minute on Small business plans, $0.35 on Large business plans) and added to your next bill. Minutes are the total length of all calls in a billing period (including time spent transferring a call), rounded up once to the next whole minute. Unused minutes don't roll over. We email you when you've used 80% and 100% of your minutes. Extra minutes in your final period before cancelling aren't charged.
- Discount codes apply as described when the code is given, and can't be exchanged for cash.
- Prices are in the currency shown at signup. We're not currently registered for GST, so no GST is charged; if that changes we'll tell you first.
- We'll give you at least 30 days' notice before changing your plan's price. If you don't agree, you can cancel before the change applies and we'll refund any fees you've paid for the period after it.
4. If a payment fails
If a payment fails, we'll email you a link to pay. While it's unpaid, your receptionist is paused, your calls are forwarded to your backup number and your dashboard is locked except for paying. Everything switches back on automatically once payment is made. While paused you can still pay or cancel from the billing page, and ask us for a copy of your data.
5. Cancelling and refunds
You can cancel at any time from your dashboard's billing page or by contacting us. Your plan stays active until the end of the period you've paid for, and then stops. We don't refund part periods or setup fees, except where the law requires it. If we end the service for a reason other than your breach of these terms, or the service fails a consumer guarantee, we'll refund the fees for the unused period. After cancelling, you can ask for an export of your data for 30 days. Before cancelling, turn off call forwarding on your phone so calls come back to you.
6. Your responsibilities
- Keep the details your receptionist uses accurate (hours, services, prices, menu and policies). It answers based on what you give it.
- Use the service lawfully. You're responsible for complying with the laws where you operate, including any rules about recording calls, using AI with customers, privacy, and telemarketing.
- Tell your callers how their information is handled and get any consent your local laws require. You authorise us and our providers (including Vapi, OpenAI and Anthropic) to process call information for you. We don't use your call information to train AI models.
- Keep your login secure and tell us about any unauthorised use.
- Don't use the service to harass people, send spam, or for anything illegal or harmful.
7. Important limits of an AI receptionist
- It is not an emergency service. It tells callers with emergencies to hang up and call their local emergency number, but it must never be relied on for emergencies. Don't use it as a triage, after-hours medical or veterinary advice line, or anywhere a missed call could cause injury. Urgent transfers only work if your transfer number answers.
- It does not give medical, legal or financial advice.
- AI can misunderstand callers or make mistakes. Check important bookings and messages in your dashboard, and contact customers directly when something matters.
- The service depends on phone networks, internet connections and third-party providers. We work to keep it running at all times but can't promise it will never be interrupted. If our system can't be reached, calls are forwarded to your backup number where possible.
8. Your data
Your business information, calls, recordings and bookings belong to you. You let us use them only to provide and improve the service, as set out in our Privacy Policy. When you leave, we can give you an export of your data.
9. Liability
Nothing in these terms removes rights you have under the Australian Consumer Law or other laws that can't be excluded. Where the law lets us limit our liability for failing a consumer guarantee, our liability is limited, at our choice, to supplying the service again or paying the cost of having it supplied again. Otherwise, to the extent the law allows, neither of us is liable for indirect or consequential loss, and each party's total liability is limited to the fees paid in the 12 months before the claim. This limit doesn't apply to your obligation to pay fees.
10. Suspension and termination
We may suspend or end your account if you seriously or repeatedly break these terms, or use the service unlawfully. Where reasonable, we'll tell you first and give you a chance to fix it.
11. Changes to these terms
We may update these terms. We'll change the date at the top and email you about important changes at least 30 days before they apply. If you don't agree, you can cancel before the change applies and we'll refund any fees paid for the period after it. If you keep using the service after that, the new terms apply.
12. General
These terms are governed by the laws of Western Australia, Australia, and the courts there have jurisdiction. If part of these terms can't be enforced, the rest still applies.
